1. Introduction
Welcome to **TotenkStore** (“we,” “us,” “our”). By placing an order, you (“you,” “Customer”) agree to this Refund Policy. Please read them carefully before ordering.
2. Definitions
- **Products**: All apparel items sold by us, each featuring a custom-printed design chosen by the Customer.
- **Personalized Goods**: All products on our website are printed on demand to the Customer’s specifications and are therefore considered personalized goods.
3. Orders and Acceptance
- All orders are subject to our acceptance and availability.
- We reserve the right to refuse or cancel any order for any reason, including but not limited to: errors in the description or pricing, or suspicion of fraud.
4. “No-Return” Policy for Personalized Goods
Because each garment is printed on demand to your specifications:
- **All sales of Personalized Goods are final.**
- **We do not accept returns or exchanges** for change of mind.
5. Regional Legal Notes on Returns & Refunds
5.1 Statutory Cooling-Off Applies but Personalized Goods Are Exempt
In the following jurisdictions the law grants consumers a limited “cooling-off” or “right of withdrawal,” **but expressly exempts personalized or made-to-order items**:
- **European Union (14-day period):** Austria; Belgium; Bulgaria; Croatia; Cyprus; Czech Republic; Denmark; Estonia; Finland; France; Germany; Greece; Hungary; Ireland; Italy; Latvia; Lithuania; Luxembourg; Malta; Netherlands; Poland; Portugal; Romania; Slovakia; Slovenia; Spain; Sweden.
- **Brazil (7-day period)**
- **China (7-day period for intact, unopened goods)**
**Result:** Our custom-printed clothes are exempt—no statutory right of return in these countries.
5.2 No Statutory Cooling-Off for Standard E-Commerce
In these jurisdictions there is **no mandatory right of withdrawal** for online purchases. Merchants may set their own policies, and ours is no returns on Personalized Goods:
- **North America:** United States; Canada
- **Europe (non-EU):** United Kingdom; Norway; Switzerland
- **Asia:** Japan; India
- **Latin America:** Argentina; Chile; Colombia; (and most other LATAM countries)
- **Oceania:** Australia; New Zealand
- **Africa:** South Africa; (and most other African countries)
- **All other jurisdictions** not listed in § 5.1
**Result:** We do not accept returns or chargebacks for change of mind in these countries. Any payment-provider chargeback rights remain subject to your agreement with them, but our policy is final sale on all Personalized Goods.
6. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any incidental or consequential damages arising from your purchase or use of our Products.
7. Governing Law & Dispute Resolution
These Terms are governed by the laws of the country in which our registered office resides. Any dispute shall be resolved in the courts of that jurisdiction, except where mandatory local consumer-protection statutes require otherwise.
8. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date will reflect the most recent revision.
